Preparing your home for Hurricane Season

The Local Business Tax Receipt is imposed for the privilege of doing business in the City of Sebastian. Anyone that engages in any type of business within the City limits is required to have a City of Sebastian Local Business Tax Receipt.

All receipts are sold or renewed by the City beginning July 1 of each year, are due and payable on or before September 30 of each year, and expire on September 30 of the succeeding year. Receipts not renewed by September 30 become delinquent and subject to a penalty of 10% for the month of October and an additional 5% for each month of delinquency thereafter. However, the total delinquency penalty may not exceed 25 percent of the tax for the delinquent establishment. The fee for new Local Business Tax Receipts issued from April 1, through September 30, shall be one-half the regular annual license tax.

The City of Sebastian has fixed Business Tax fees as established by the City Council. These fees are attached to a classification that would describe your business MUNICODE SECTION 30-51

Application packets for Local Business Tax Receipts For Commercial Locations can be obtained at Sebastian City Hall, 1225 Main Street, Building Department or Online. In addition to the application form, the following is required:


 

HOME BASED BUSINESSES
City of Sebastian Land Development Code Section 54-2-7.21

1. Application fee $150.00 (this does not include license fee). Payment must be made in cash, check, or money order.

2. Floor plan of home marking the area where the business will be conducted, even if only the telephone is to be used. The business may not take up more than 20% of the living area of the home.

3. Recent photograph of the front of the home, include front yard and driveway.

4. Letter of intent (tell us, in writing what you plan to do).

5. Copy of Fictitious/Corporation Name Registration. For more information or filing forms visit Florida Department of State, Division of Corporations @ www.sunbiz.org or call (850) 488-9000 to have forms mailed to you.

6. The Application will be reviewed and approved by Building Department.

7. The approval process usually takes 3 weeks. You may find out the status of the application by calling Building Department, 388-8211.

8. After payment of tax fee, the City Local Business Tax Receipt will be issued. You may come to the City’s Building Department to make the payment or you may mail in the payment directly to Sebastian City Hall address:

BUSINESS TAX APPLICATION FOR COMMERCIAL LOCATIONS
MUNICODE SECTION 30

1. Any person applying for a Business Tax Receipt to practice any profession regulated by the department of business and professional regulation, or any board or commission thereof, must provide proof of an active state certificate, registration, or license, or issuance of the same

2. Any person applying for a Local Business Tax Receipt or a transfer of an existing receipt must present a copy of the applicant's current fictitious name registration issued by the state division of corporations or a written statement signed by the applicant setting forth the reason that the applicant need not comply with the Fictitious Name Act.

3. Business Tax applications must be submitted 2 weeks prior to the start of the business.

SECTION 2.
Penalties
. Any person who commences any work on a building, structure, electrical, gas, mechanical, or plumbing system before applying for the necessary permits shall be subject to a penalty of $200 for an owner or $300 for a contractor, or one hundred percent (100%) of the usual permit fee, in addition to the required permit fees. The payment of such penalty shall not relieve any person(s) from complying with the requirement of the Code of Ordinances or this resolution in the execution of the work, or from any other penalties of the Code of Ordinances.

SECTION 3.
Plan-checking fees.
When the valuation of the proposed construction under a General Building Permit exceeds three thousand dollars ($3000) and requires a plan to be submitted under the Florida Building Code or Chapter 26, Article II of the Code of Ordinances, a plan-checking fee shall be paid to the building department at the time of submitting plans and specifications for checking. Said plan-checking fee shall be equal to ten percent (10%) of the building fee set forth herein. Such plan-checking fee shall be in addition to the building permit fee.

 


 

Payment to the City by Credit Cards

The City is pleased to offer customers the option of making payments by credit cards at the main cashier’s window at City Hall. They may also submit a one-time credit card authorization form via fax to the cashier’s office. However, please note there is a fee associated with this service. The service is provided through a company named Point and Pay, LLC and they charge a convenience/processing fee to customers who elect to use this method of payment. Visa, Master Card, Discover and American Express are acceptable. The charge is a minimum of $2.95 up to $100, plus $2.00 for every $100 increment above that. The City does not retain any portion of this fee.

A MESSAGE FROM THE

Repairs to your home or business will require Building Permits in most cases. Please contact the Building Department to find out if your repair will require a permit and inspections at 772-589-5537.

If you are hiring a contractor that person must hold a certificate of competency under Florida Statute 489 and local ordinances.

The purpose of the Licensing Regulation and enforcement is to ensure construction activities are performed by fully qualified individuals and see that all work gets inspected to the current code requirements.

CAUTION: A Local Business Tax Reciept is not a Contractor’s License!!! It is a “Local Business Tax Reciept Tax.”

If a Contractor is not licensed, he/she is likely to be uninsured. The unlicensed contractor now becomes your liability. If he/she falls off a roof or ladder and is injured, who will pay for his injuries? YOU! Most homeowner policies will not pay a claim if the homeowner has contracted with an unlicensed contractor. Now that unlicensed contractor can bring suit against YOU!

Unfortunately, there is little you can do after allowing an unlicensed contractor to work for you; the State, County, or City does not regulate them. They may not reside here, and now left the area.
The City’s Licensing Board or the State Department of Business and Professional Regulation’s Construction Industry Licensing Board issue the Certificate of Competency.

Qualified Contractor’s must register with the City to show the required licenses and proof of insurance in order to obtain a permit. You may contact the Building Department at 772-589-5537 to find out if a Contractor has registered with the City. Qualified Contractor’s who have not registered, may call 772-589-5537 to make an appointment. The City of Sebastian Building Department is located at 1225 Main St. You may also check licensing information and complaints with the State at myflorida.com. NOTE: Building Permits will only be issued to Contractors that have a valid contract signed by the homeowner.


“Ways to identify a possible unlicensed contractor”

1. A Contractor who is not willing to put a contract in writing.
2. They ask you to obtain the permit instead of them.
3. The contractor tells you a permit is not necessary. Call the Building Department at 772-589-5537 to determine if a permit and inspections are required.
4. They request a large down payment before work begins or you are asked to pay in cash or make a check out to cash.
5. The contractor cannot provide you with a copy of the license or proof of insurance.
6. Contractor does not display a license number on advertisements, business cards, vehicle, contracts, etc.
7. They are only willing to work at night and on weekends.

BUILDING DEPARTMENT MISSION STATEMENT

Our mission is to effectively promote and provide professional plan review, permitting and inspection of building construction to ensure a safe built environment for all those who live and work in the City of Sebastian.

The Building Department ensures compliance with all state and local codes to protect the health, safety and welfare of our residents. Our professional and courteous staff is available to assist you with your construction project.

The Building Department provides the following services:

  • Perform plan reviews, issue building permits and perform inspections for all construction including: Single-family residences, commercial buildings, additions, alterations, repairs, swimming pools, screen enclosures, fences, storage sheds, re-roofs, water hook-ups, and other construction activity.

  • Issuance of land clearing, grubbing, tree removal, driveway and dewatering permits.

  • Contractor Licensing: All contractors who work in the city must be licensed and registered with the city. Contractors must provide licensure and proof of liability and workman’s compensation insurance or exemption.
  • Business Tax Receipts are processed for businesses located within city limits.

 

The Florida Building Code 5th Edition Effective date is June 30, 2015
Ultimate Wind Speeds obtained from Figures 1609 A, B, C of the Florida Building Code for Risk Categories I, II, III and IV using Exposures B, C or D will be applicable in accordance with the provisions as set forth in section 1609.4 of the FBC.

By City Ordinance No. O-12-08 the adopted Ultimate Wind Speeds for Sebastian are: 150 mph for Risk Category I; 160 mph for Risk Category II; and 170 mph for Risk Categories III and IV.
